Welcome to Ostreum. These Terms & Conditions govern your use of our services and website. By engaging our services or using our website, you agree to be bound by these terms. Please read them carefully.

1. About Ostreum

Ostreum provides luxury oyster catering and entertainment services for private events, corporate gatherings, yacht experiences, and exclusive venues worldwide. Our services include oyster and caviar service, sommelier-led tastings, and bespoke culinary experiences.

2. Service Booking & Reservations

Booking Process:

  • All bookings are subject to availability and confirmation by Ostreum
  • A booking is confirmed only when you receive written confirmation from us
  • We recommend booking at least 2-3 weeks in advance, though we accommodate last-minute requests when possible

Information Requirements:

  • You must provide accurate event details including date, location, guest count, and any special requirements
  • Any dietary restrictions, allergies, or preferences must be communicated at the time of booking
  • Changes to event details must be communicated as soon as possible

3. Pricing & Payment

Pricing:

  • All prices are quoted in the currency specified and are subject to change until booking confirmation
  • Prices include the services explicitly outlined in your booking confirmation
  • Additional services, premium oyster selections, or extended service hours may incur additional charges
  • Travel costs for international events may apply and will be detailed in your quote

Payment Terms:

  • A deposit of 50% is required upon booking confirmation to secure your reservation
  • The remaining balance is due 7 days prior to the event date
  • Payment can be made via bank transfer or other agreed methods
  • Late payments may result in cancellation of your booking

Taxes & Fees:

  • All prices are exclusive of applicable taxes, duties, and service charges unless otherwise stated
  • You are responsible for any local taxes or fees associated with the event

4. Cancellations & Modifications

By Client:

  • Cancellations made 14+ days before the event: Full refund minus 25% administrative fee
  • Cancellations made 7-13 days before the event: 50% refund of total booking value
  • Cancellations made less than 7 days before the event: No refund
  • Deposits are non-refundable in all circumstances

Modifications:

  • Minor changes (guest count adjustments of ±10%, timing changes) can be made up to 7 days before the event at no additional charge
  • Significant changes may be treated as a cancellation and rebooking
  • Guest count increases may incur additional charges; decreases do not result in refunds if made within 7 days of the event

By Ostreum:

  • We reserve the right to cancel or reschedule services due to circumstances beyond our control
  • In the event of cancellation by Ostreum, you will receive a full refund or the option to reschedule
  • We are not liable for any consequential losses resulting from cancellation

5. Event Execution & Client Responsibilities

Venue Access:

  • You must ensure we have appropriate access to the event venue at the agreed time
  • Adequate space, facilities, and utilities (water, electricity if required) must be provided
  • Any venue restrictions or requirements must be communicated in advance

Guest Behavior:

  • You are responsible for the conduct of your guests during the event
  • We reserve the right to refuse service or terminate the event if guest behavior is inappropriate, threatening, or unsafe
  • Any damage to Ostreum equipment or property caused by guests will be charged to the client

Health & Safety:

  • All oysters and food products are prepared following strict hygiene and safety standards
  • We cannot guarantee against allergic reactions; guests consume products at their own risk
  • You must inform us of any known allergies among guests

6. Liability & Insurance

Our Liability:

  • Our liability is limited to the total value of your booking
  • We are not liable for indirect, consequential, or incidental damages
  • We maintain appropriate insurance coverage for our operations

Your Liability:

  • You are responsible for any loss or damage to Ostreum property, equipment, or products caused by you or your guests
  • You agree to indemnify Ostreum against claims arising from your event

Food Safety:

  • While we maintain the highest standards, we cannot be held liable for individual reactions to food products
  • Oysters and seafood are natural products and consumption is at the guest's own risk

7. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including but not limited to:

  • Natural disasters, severe weather conditions
  • Government restrictions, public health emergencies
  • Transportation failures, supply chain disruptions
  • Strikes, labor disputes
  • Venue closures or access restrictions

In such cases, we will work with you to reschedule or provide a proportional refund.

8. Intellectual Property

Content Ownership:

  • All content on our website, including text, images, logos, and designs, is owned by Ostreum or licensed to us
  • You may not reproduce, distribute, or use our content without written permission

Event Photography:

  • We may photograph or film events for marketing purposes
  • By engaging our services, you consent to such use unless you explicitly opt out in writing
  • We respect guest privacy and obtain consent where required

9. Ostreum Inner Circle Membership

Membership Terms:

  • Membership to the Ostreum Inner Circle is subject to separate terms and application approval
  • Membership benefits, terms, and fees are detailed in the membership agreement
  • Membership is non-transferable and may be revoked for breach of terms

10. Privacy & Data Protection

Your personal information is handled in accordance with our Privacy Policy. By engaging our services, you consent to the collection, use, and processing of your data as described in our Privacy Policy.

11. Complaints & Dispute Resolution

Complaints Procedure:

  • We strive for excellence in every experience
  • Any complaints should be raised during the event or within 48 hours of the event conclusion
  • Complaints should be submitted in writing via email or through our contact form
  • We will investigate and respond to all complaints within 14 days

Resolution:

  • We will make reasonable efforts to resolve disputes amicably
  • If resolution cannot be reached, disputes will be subject to the governing law and jurisdiction outlined below

12. Website Use

Acceptable Use:

  • You may use our website for lawful purposes only
  • You must not misuse our website or attempt to gain unauthorized access
  • We reserve the right to suspend or terminate access for misuse

Third-Party Links:

  • Our website may contain links to third-party sites
  • We are not responsible for the content or practices of external sites

13. Amendments

14. Governing Law & Jurisdiction

These Terms & Conditions are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

15. Severability

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
